 Tiffin Kitchen, LLC (DBA Chai High Tea/ Afternoon Chai) CONSUMER AGREEMENT AND WAIVER

 1. Binding Agreement. These Terms and Conditions govern your use of your purchase of any Tiffin Kitchen, LLC (DBA Afternoon Chai/ Chai High Tea) foods, services, and products, whether from the website or otherwise. By placing any order for Tiffin Kitchen, LLC products, services, classes or meal plans, you agree to be legally bound by these Terms and Conditions. Tiffin Kitchen, LLC reserves the right, in its sole discretion to alter, amend, add, remove, or otherwise modify any portion of these Terms and Conditions at any time. By placing an order and using the service with Tiffin Kitchen, LLC, after these Terms and Conditions have been modified, you agree to accept all such modifications to the Terms and Conditions. 

2. Disclaimer. Tiffin Kitchen, LLC shall not be responsible or liable, under any circumstances, for any illness or health problem that may result from the consumption of its prepared foods, meals, services, or other products. Tiffin Kitchen, LLC may not be appropriate for certain people including people who 1) have food allergies; or 2) are under 18 years of age.

3. Allergies. Tiffin Kitchen, LLC shall not be liable for an allergic reaction you have to any foods, products, or meal plans, purchased from, prepared by, or delivered by Tiffin Kitchen, LLC. The most common food allergens are: gluten (wheat), peanuts, soy, shellfish, dairy, eggs, nuts, and fish. With advanced notice, Tiffin Kitchen, LLC can sometimes accommodate dietary restrictions. However, our items are prepared in a commercial kitchen that regularly processes the above food allergens. If you’re allergic to any of these items, you should know that while we make every effort not to do so, we cannot guarantee that there won’t be any cross-contamination.  Please note that Tiffin Kitchen, LLC reserves the right to modify class menus at any time due to ingredient availability or seasonality.

4. Indemnity. You agree to indemnify, defend, protect, and hold Tiffin Kitchen, LLC and its suppliers, licensors, affiliates, shareholders, officers, directors, employees, and agents from and against any and all claims, actions, awards, demands, damages, obligations, losses, liabilities, settlements, costs, and expenses (including, but not limited to, reasonable attorneys’ fees) arising from or relating to: 1) your use of and access to Tiffin Kitchen, LLC programs and website; 2) your violation of any of these Terms and Conditions; and 3) your use of and consumption of any Tiffin Kitchen, LLC food or other products. This indemnification shall survive the termination of these terms and your use of Tiffin Kitchen, LLC’s site, products, and/or services. 

5. Severability. If any provision of these Terms is found to be invalid, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

6.  Cancellation Policy:

Tea Brewing, Tasting and Cooking Classes: For any at-home or at-venue classes, we require a deposit to book, which is fully refundable up to 14 days prior to the class start date/time. An invoice with a due date for full payment will be sent via e-mail to pay online closer to the class date, which is due 72- hours before the class start date and time. If attendees need to cancel for any reason after this 72-hour period, we can offer a 50% refund (minus processing fees) if the cancellation notice is received (in writing) at least 24 hours before the class start date/time. We CANNOT accommodate any refund requests made later than 24 hours before the class start time. However, attendance is transferrable and you can send someone in your place - just let us know before the class starts.

In-Person Chai “High Tea”: We can generally accommodate full refunds up to 72 hours prior to the event start time, on a case-by-case basis.

Virtual Classes: Our virtual classes are currently being offered via the Eventbrite website. Please refer to specific event pages for Refund/Cancellation policy information.

Products for Pickup/Delivery: We can provide full refunds up to 48 hours in advance of 8 a.m. on the date of pickup/delivery. We are unable to provide any refunds after this time.

If Tiffin Kitchen, LLC must cancel a class due to inclement weather, COVID-related restrictions, or other circumstances beyond our control (e.g., power outages, facility issues, etc.), we will attempt to notify you by email or telephone with as much notice as possible, after which we will issue a full refund within 72 hours of notice. However, if we do not affirmatively cancel a class by email or telephone and you are unable to attend, our standard cancellation policy applies.

7.  Assumption of Risk:

The attendee assumes all risks and accepts sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that attendee may experience or incur in connection with attending any Tiffin Kitchen, LLC event. Attendee hereby releases, covenants not to sue, discharges, and holds harmless Tiffin Kitchen, LLC, its employees, agents, and representatives, of and from any such claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto.

Specifically relating to the global COVID-19 pandemic, the attendee acknowledges the highly contagious nature of COVID-19 and voluntarily assumes the risk of exposure or infection by attending any Tiffin Kitchen, LLC event, and that such exposure or infection may result in personal injury, illness, disability, and/or death to the attendee. Attendee understands that the risk of becoming exposed to or infected by COVID-19 at Chai High Tea may result from the actions, omissions, or negligence of others who may attend the event or their families, colleagues, or others with whom they may have contact. Accordingly, the attendee understands and agrees that this release includes any claims based on the actions, omissions, or negligence of Tiffin Kitchen, LLC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in the Chai High Tea Event.

In addition to all other rules and regulations relating to the attendee’s attendance at Chai High Tea, the attendee agrees to comply with all COVID-related procedures that may be implemented by Tiffin Kitchen, LLC and the event venue, including, but not limited to, mask-wearing and social distancing requirements and restrictions on certain activities that carry higher COVID-related risk, in order to protect as much as possible the health and safety of all Chai High Tea attendees.

8. Online + In-Person Cooking Class Wavier and Media Release I understand that by turning on my electronic device’s camera during an Online Cooking Class, it will broadcast to the Chef and class participants. I understand that during in-person events and classes, photos and videos will be taken by Tiffin Kitchen, LLC, designated photographers/videographers and/or attendees. I consent to and allow any reproduction of any and all photographs or video recordings taken of myself or a member of my household during our participation in virtual and/or in-person classes events. I agree with Tiffin Kitchen, LLC’s right to use or reproduce such photographs and video recordings in any media, including social media or online.

9. Entire Agreement. These terms constitute the entire agreement between you and Tiffin Kitchen, LLC. Neither party shall be bound by any conditions, definitions, warranties, or representations with respect to any other terms or conditions except as expressly provided in these written terms. 

By purchasing my class ticket, event ticket, product and/or service, I agree to abide by the terms and conditions set forth in this agreement.
